What surprised me is that he did this so quickly, mere hours after it was determined Libby would have to go to jail during his appeal. The commutation allows him to continue to appeal, with the potential for a full pardon at the end of the term.

Just off the cuff, you could say it's kind of a conflict of interest to commute the sentence of someone that was convicted of crimes committed in your administration; it's not just a friend or donor whose crime was unconnected to the White House (assuming, of course, we don't believe Cheney's claims to be FourthBranch.)

But taken in the broader context of this administration, it's really just another in what can be interpreted as "your laws don't apply to the executive branch" moves by Bush & Co.
And seconding spf, I believe there will be a full pardon in it for Scooter on January 19, 2009. Especially if a Democrat gets elected. The chances of which aren't hurt any by slick political moves like this.

Also, if Libby is still appealing, it means that he can continue to take the 5th -- he can't be made to testify under oath.
If Libby was pardoned, he would no longer be able to do that. Commuting the sentence rather than pardoning keeps Libby immune from being forced to testify against Cheney or whoever.

I got your back on that one. I remember hearing somewhere that if you receive a pardon, you are also admitting guilt in the matter. That would put quite a damper on his appeal process. | CEOIII
