I'm pretty surprised.

This has to hurt the administration's credibility a little.

How does this not give the appearance that the administration feels it is above the law?

Bush has such crappy approval ratings that I really don't think this will hurt him that much, but you are correct, this does give the impression that this administration feels above the law.

What surprised me is that he did this so quickly, mere hours after it was determined Libby would have to go to jail during his appeal. If Bush had waited even a couple of days it would give the appearance that he thought about it a little rather than having this all worked out ahead of time.

hey, Dick Cheney is claiming that the Vice President isn't a part of the Executive Branch, so going just by that, I'd say that this administration is just one huge clusterfuck that the American people have gotten themselves into.

Pretty much, nothing surprises me about the shit they do anymore.

I'm still waith=ing for Bush to plaster his face on some currency... you know his ass is thinking about it.

I wonder if there's some reason to commute the sentence rather than pardon him. Can a pardon be overturned? The article says that a commutation cannot be challenged by anyone.

The commutation allows him to continue to appeal, with the potential for a full pardon at the end of the term.

And really, when your approval ratings are 28% you might as well take care of the few friends you have left.

Can someone please explain to me how this is so much worse than previous pardons. I'm pretty sure that Libby wasn't paying hundreds of thousands of dollars to Laura Bush's brother for legal counsel at the time either.

Just off the cuff, you could say it's kind of a conflict of interest to commute the sentence of someone that was convicted of crimes committed in your administration; it's not just a friend or donor whose crime was unconnected to the White House (assuming, of course, we don't believe Cheney's claims to be FourthBranch.)

That said, he did have every legal right to do it.

I don't think that viewed by itself, this commutation is any worse than many that have been put through by past Presidents. But taken in the broader context of this administration, it's really just another in what can be interpreted as "your laws don't apply to the executive branch" moves by Bush & Co.

And seconding spf, I believe there will be a full pardon in it for Scooter on January 19, 2009. Especially if a Democrat gets elected. The chances of which aren't hurt any by slick political moves like this.

Note: As far as I know, Presidential pardons are equally final.

Also, if Libby is still appealing, it means that he can continue to take the 5th -- he can't be made to testify under oath.

If Libby was pardoned, he would no longer be able to do that. Commuting the sentence rather than pardoning keeps Libby immune from being forced to testify against Cheney or whoever.

I got your back on that one. I remember hearing somewhere that if you receive a pardon, you are also admitting guilt in the matter. That would put quite a damper on his appeal process.
