Bullshit!

Rogers Sportsnet is reporting tonight that because a.) Dany Heatley wasn't drunk when he crashed his car and b.) Dan Snyder's family forgives him, the prosecutors may not pursue felony charges against Heatley.

What the hell is that?

He was going way over the speed limit in a residential zone and killed a man. Forgiveness may be good for his peace of mind, but someone who does that deserves to be punished. Kill a man, go to jail. It really should be that simple.

The old "eye for an eye," huh? Very Old Testament of you...but it's not that simple, and I'm sure you realize that.

If Heatley goes to jail, what does that solve? One life is already lost in a horrific *accident* (please notice the emphasis on accident) and Heatley will never be the same as a player or, more importantly, as a man. The forgiveness of Snyder's family is NOT going to help this guy anymore than you or I feeling sorry for him would.

Is spending 15 years in jail going to bring Snyder back? Of course not.

If you applied that logic universally, you'd have a lot of killers walking the streets. Should "I'm sorry" now be accepted as a defense in our courts? I don't doubt that Heatley is sorry for what happened, but the fact is a man died as a result of Heatley doing something that any reasonable person knows is stupid. Should I be allowed to drive my car at 130 km/h through residential neighbourhoods? I'd be pretty sorry if I killed someone...does that make it OK?

Not punishing Heatley says that the prosecutors condone what he did. I'm not saying he should get the chair, but the very idea of a criminal justice system is based largely on two principles: the idea that wrongdoers should be punished for their actions, and that such punishment will act as a deterrent to others. If you let Heatley walk away from what he did - and regardless of whether he intended the outcome, he still knew what he was doing when he pressed down on the gas pedal - the system fails.

Why do I hear the voice of Lisa Simpson asking Judge Schneider to declare a writ of "boys will be boys"?

I don't think you are being entirely fair to Heatley. Was Dany Heatley driving too fast? Apparently, but I haven't seen anything about the speed other than eyewitness accounts that he was going 80 mph. Is it possible that forensic evidence would show that he was driving 55 instead of 80? Yes. And if he was going 80, I read where Teemu Selanne, a Ferrari aficionado, said it is very easy to go 80 in a Ferreri and feel like you are going 40. So it's possible he was not speeding "with intent" and instead is just guilty of not minding the speedometer.

Will the world be a better place if Dany Heatley is in jail? Not likely. Will Dany Heatley be taught a lesson greater than the one he has already learned by spending time in jail? Not likely.

It's not like he was handling a gun and accidentally shot Snyder...he was just doing an activity he and most people do every day.

You can punish Heatley without locking him in a cell for years.

Is Dany Heatley a danger to society?

I would rather that Heatley was sentenced to never be allowed to drive again, be on probation for a few years, and do tremendous amounts of community service educating young people about the dangers of driving.

There can be a positive to come out of this because I believe that Heatley going to schools and telling the story of being responsible for the death of his friend by simply driving too fast, would be a very real and chilling message.

I don't think people are out there going, "Whatever, I don't care if I kill my friend because I won't go to jail anyways."

Again, he can be punished without sitting in a cell which I don't see as solving a thing.

I don't think any of us are saying "don't punish Heatley." Of course there will be some penalty handed down here, be it probation or what have you. Jail isn't the answer here.

And of course the "I'm sorry" defense isn't the issue here, either. I haven't heard that from his lawyers, nor have I heard it from Heatley himself. If, in a court of law, they try that angle, then you have a point. Until then, however...it's merely hearsay.

Let's not start creating truths here...

I absolutely sympathize with Heatley here, but...

He did break the law by recklessly disobeying the speed limit, and that offense cost another person his life. Unfortunately, I think he deserves some jail time here. If this was not an professional athlete, the guy would be serving a few years, no doubt. I have no doubt that Heatley is very sorry for his actions, but the law is the law. This guy should be facing a serious voluntary manslaughter charge here. (Or involuntary- I'm not too good with the law)

The sad part is, most of my friends are just upset that they took him in their fantasy leagues and are upset that he won't help their team now. Goes to show you what kind of presidence sports take in people's lives nowadays...

The people really driving this are Snyder's family. They are the ones who requested that Heatley not be held to any criminal charges. If they feel that way, that's good enough for me.

I think that you look at the person and judge whether taking their freedom away would do ANY good for either them or society. I would not dispute that Heatley should get a very lengthy probation with serious reprecussions (i.e. "you're goin' to jail, buddy") if he commits another driving-related offense. However, I don't think it does ANY more good for Dany Heatley to send him away for five years or ten years or one year when the whole thing was just a terrible accident and he lost a good friend. I know *I* wouldn't have to be sent to jail if I were in Heatley's shoes.
