About Jin's flashback:

My roommate is convinced that it was a flash forward. Like many others, he didn't realize it was (potentially) a flashback while he was watching it, but in addition to that, he says that some of the toys in the store where Jin buys the panda are based on TV shows that didn't exist back in 2004. Also, he felt that Jin's job working for Sun's dad was less diplomat-delivering-toys-to-newborns and more hired-muscle-beating-people-senseless.

LOST writers are usually pretty meticulous when it comes to details like that, so I'm thinking maybe he's right and that actually WAS a flash forward - meaning Jin is off the island and has re-married. I think this would also mean that somehow people don't recognize Jin as one of the Oceanic survivors, so his leaving the island couldn't have been publicized at all. Obviously just accepting it as a Jin flashback is much easier to swallow, but now I'm having a hard time reconciling the toy anachronisms. And with all the craziness going on with timelines, I feel like almost anything is possible now.

If Jack was allegedly Aaron's father, I think that would have come up during his testimony, especially with reference to the "Do you love her?" question. I think the reason they said two members of the crash survived and then died is to explain the two pregnancies. (Although, if that's the case, Jin would have been the easiest person to attribute Sun's pregnancy to, which doesn't make sense if his gravestone says 9/22/04 as alleged.)

I remember watching Jack's flash-forward and thinking his cell phone seemed too recent for pre-2004. When Jin's cell phone got run over, I remember thinking it seemed a bit thicker than modern cell phones. I expect there's enough ambiguity regarding Jin's flash-back/forward that, if it is a flashback, the writers will definitively say so on an upcoming podcast. Unless the ambiguity is intentional, in which case they'll perpetuate it.

You believe me, don't you?
Please believe what I just said...

Jin's scenes were definitely flashbacks. The easiest way to prove it was the toy store guy saying it was the year of the dragon - the last was 2001, and the next is 2012. Couple that with the older model cell phone, shouting at the cab-stealer that he'll kill him (he just said on the island he's not that man any more), saying he's only been married 2 months, and saying he's working for Mr. Paik (how's he going to do that if he's supposedly dead as of 9/22/04?), I think it's pretty easy to prove they were flashback scenes.

Re: the discrepency about Jin's death date. Supposing that he is one of the 'Oceanic Two' who survive the crash but die in the interim before the O6 are rescued, it's possible that the cover story is that Jin suffered some injury in the crash that worsened and he eventually died. In the interim, he managed to father Ji Yeon (since let's be honest, if you're married to Yunjin Kim, you'll want to get it on even if you're in a body cast). The death date was given as 9/22/04 on the tombstone since the O6 don't actually know what date he died -- they had no way of accurately measuring time on whatever non-Island island they claim to have ended up on.

“How is it that I am a good actor? What I do is I... pretend to be the person I’m portraying. You’re confused. Case in point: in Lord of the Rings, Peter Jackson comes to me and says ‘I would like you to be Gandalf the Wizard,’ and I said ‘You are aware that I am not really a wizard?’ and Peter Jackson said ‘I would like you to use your acting skills to portray a wizard for the duration of the show.’ So I said ‘Okay’ and then I said to myself ‘Mmm.. How do I do that?’ And this is what I did: I imagined that I was a wizard, and then I pretended, and acted, in that way on the stage. How did I know what to say? The words were written down for me in a script. How did I know where to stand? People told me where to stand." -- Sir Ian McKellen, Extras

I haven't been intently following the interworkings of TWoP - I read some recaps, and visit their board once an eon - but I do recall maybe two or three times where it seemed the site nearly blinked out of existence but was saved by some sponsorship deal ...
