An Article (news.enquirer.com).

More power to him, I guess, though I take qualms with Shark Boy's line about trying to take his character seriously and the writer's claim that TNA is a "touring company". Disney is Disney however, so I've got to wonder if anything will ever come out of this, even if he does own the copywrite.

According the story picked up by MTV, Dean "Shark Boy" Roll got his idea from the Toadies song "I Come From the Water".

The article also states that he got the "Shark Boy" gimmick trademarked in 2000, so he might just have a case on his hands.

Isn't it a bit too late for this? With the movie opening tomorrow, the film, posters, and etc. have already been sent to theaters. I'd seriously doubt that he can remove the name in the next few days and "restore his tough-guy image he's going for." Therefore, is it possible his TNA paycheck just isn't cutting it for his wife and two kids so he's just seeking a little extra cash in his wallet? The only thing I see him possibly accomplishing is changing the title on DVD release.

I doubt he really wants the title changed. I have a feeling that his wounded pride would be comforted by Dimension Films buying his trademark for a healthy chunk of change.

I also suspect he's just after some money, and I think he should get it. I was actually wondering what was taking him so long, because I remembered that he had the name copywrited. It's actually a pretty clear-cut case of infringement, but the way these things go it could be years before the suit is settled.

Disney has a TON of money & a TON of lawyers on their side. I agree with Sharkboy on this, I just hope Disney's army of lawyers doesnt drag this out longer than he can afford.

I hope that Shark Boy not only wins but forces Disney's execs to promise to NEVER EVER make a 3D movie ever again. Spy Kids 3D was possibly the worst movie made in 03.

If you happened to catch BTR his "TRADEMARK" might not stand up to the Disney. It comes down to how public knowing who is who in the general public

If more people know of Sharkboy Disney they Sharkboy Wrestler might not win. It is the same thing that happened in Europe with WWF vs WWF. Apparently WWF in Europe was more known as the Panda people than WWF Wrestling. Thus they lost case over there. We'll see who wins. It goes something like that. Check out btr.com to listen to the legal explaination the show this week.

ACTUALLY, the Panda folks owned the "WWF" trademark for decades by the time WWWF became WWF. The 2 parties agreed (in the early 90's I believe, during the big steroid trial?) that the wrestling company could also use the initials "WWF" as long as they didnt use it outside of the United States, because the Panda organization doesnt really have a presence in the U.S.

Fast forward to the wrestling boom of the late 90's: Wrestling is huge, the wrestling organization is huge worldwide, they have a big presence on the internet with WWF.com, and they change their logo from the golden block letters to the white & red scratchy "Attitude" logo. The Panda folks didnt like being mistaken for wrestlers (Rumor has it that they stepped off a plane in Europe one day, and when announced as being part of "The WWF", someone asked, "What, you mean the wrestrlers?"), they went to court in England where they're based, and claimed that the wrestling company broke their original agreement by changing their logo (the original agreement was specific about allowing the golden block letters logo) and promoting themselves outside of the U.S. (with the internet). The court agreed & Vince had to get the F out.

THAT'S why Vince lost that case, not because the panda folks happened to be more well known in Europe, which would be pretty rediculous if you think about it. Regardless of who is more well-known, if you hold a patent or copyright over something, it's YOURS, regardless of how big some other company is that tries to use it.

That being said, I think the only way Sharkboy the wrestler can outright lose this case is if the trademark he holds is somehow found to be invalid or if Disney can find some sort of loophole in it.

Frosty...you know I think that is the simplest yet best explaination of the WWF vs WWF ever written. Give yourself the ole Barry Horwitz pat on the back. Yep that's about how it went. Still listen to BTR the fellow says it comes down to if, "general public knowing which is which". If more people know Sharkboy from the movie our beloved "Sharkboy" may be on the losing end. Like you said Frosty, "Loophole". Anyways...I'm out.
