You know, they have implied that Batista knew all along that HHH was behind it. If that was the case, did he just go to Smackdown and No Way Out and attack JBL and company so that he could swerve everyone later?

No, I believe that he did it because JBL was talking shit about him. He knew that HHH set up the video, but he can't just let JBL get away with sying that he will make him look like Jane.
Yeah, I think that even though Batista probably knew all along (and his smile while overhearing the news might confirm it), he came to No Way Out for some purely recreational ass-kicking.

Many people who have been on the Real World or Survivor etc has said that after awhile, you don't even notice or pay attention to the cameras as they're always there. The backstage cameras have been around so long, that one could make the argument that wrestlers talking backstage just don't even pay attention to the cameras anymore, and thus the "invisible camera" catching all these "private" conversations.
Hey, I didn't say it was a good excuse....just one possible explaination.

I could see forgetting the cameras on "The Real World," but backstage there are CAMERAMEN standing right there with the camera. Hard to not notice that.
I see that Justin Credible is on their roster, though he may be wrestling under a different name now. More wrestling leagues is always a good thing, but I don't really see this getting very far.
