Lawsuit Challenges Nation’s First Homosexual Public School As Unlawful
New York, NY – Today New York State Senator, Ruben Diaz, Sr., along with a parent representing her four children under the anonymous name of “Doe”, filed a lawsuit in the New York Supreme Court challenging the legitimacy of the nation’s first “lesbian, gay, bisexual, transgender and questioning youth” (LGBTQ) public school, known as the Harvey Milk School. The children attend several poor, failing and under-funded public schools. The Plaintiffs are represented by Liberty Counsel attorneys, Mathew D. Staver and Rena Lindevaldsen.

A few weeks ago, New York City Mayor Michael Bloomberg announced that the City authorized 3.2 million dollars to establish the Harvey Milk School as the first publicly funded LGBTQ school in America. The money diverted to the School was taken from the capital expansion funds, and thus much needed capital expenditures for needy schools have suffered.

About 84% of the children served by the New York School System are racial minorities. Fifty-five percent of 3rd through 8th graders failed the state reading exams, and 65% of 3rd through 7th graders failed the math exams. In some schools, as many as 95% of the students fail basic competence evaluations. This year New York’s highest court found the schools “deficient” in learning, lacking “sound basic education,” and reported that the infrastructure was in poor shape with leaky roofs, lack of heating, and other hazardous conditions. Despite the pitiful status of the education system and the lack of funds, the City took 3.2 million dollars away from these minority student schools and diverted the money to fund a school that discriminates based on sexual preferences where heterosexuals are not welcome.

The lawsuit challenges the validity of the public school. New York Chancellor Regulation A-830 requires an equal education opportunity and prohibits discrimination based on “sexual orientation.” Thus the School, which discriminates against heterosexuals, violates the Regulation. New York law also allows taxpayers to challenge public expenditures. The suit claims the expenditure is an unlawful use of tax dollars to finance a LBGTQ school in light of the lack of funds for needy schools. The suit also points out that New York law guarantees the right to receive a quality public education, and the establishment of a homosexual-only school violates the equal protection rights of school children attending poor, failing schools and under-funded public schools.

Staver commented, “New York City officials robbed from the poor, under-funded minority schools to pay for a homosexual school. Rather than providing a “model” to the nation, New York City officials have provided a blueprint of what not to do. This wasteful use of tax dollars must be stopped.” Lindevaldsen concluded, “As one who attended law school in Brooklyn, the City’s actions are an affront to all New Yorkers, and indeed to all Americans.”

I can't wait for things to compartmentalize even further. Lefty-only schools! Brunette-only schools! Blonde-only schools, with remedial classes (I kid...)! All funded with taxpayer money!

It makes one wonder, though... how much in real dollars will this school actually cost? Is this a better or worse expenditure than spending billions of dollars on next-generation tanks when armored vehicles are rapidly becoming pointless in an age of invisible airstrikes, satellite-mounted laser beam weapons, intense surviellance of civil rights leaders, or any of the other goofy things our government's spent big bucks on through the decades?

Not trying to stir things... just seriously wondering where you all'd put this, in the big picture.

Nate, have you ever heard of any father saying "Left-handed?! YOU'RE NO SON OF MINE!" and then beating the shit out of him? And what's the incidence rate of teen lefty suicide anyway? How about black and latino teen lefty suicide?

Queer kids do not need a publicly financed high school. However a portion of the dollars New York is willing to spend on the school would be well spent on counciling problems. By and large being gay in high school is about the same thing as being the lone negro at Lynchburg, TN Amalgamated High School (football team: The Clan Dragons.)

Being left-handed isn't as bad as being gay, no. (Do a little bit of research, though, and you find out that being a lefty used to be considered a sign of demonic taint.) I wasn't even TRYING to equate the two, and insinuating that I was is just absurd. Read the rest of the paragraph for cryin' out loud.

The last thing anyone needs is school segregation again, voluntary or no. The further apart we keep ourselves from anyone who's different, the less chance anything will ever get accomplished. It's a hell of a lot easier to demonize someone when you don't see them every day walking the halls like everyone else.

Counseling for the minority kids is a start, but I'd say the money'd be better spent on the actual problems, not the symptoms.

I was thinking about this and I can see it from both sides.

If we segregate ourselves from society we will never be able to accept each other for our differences and move on (I know I am pretty much quoting someone on that)

However, I don't feel this is a bad idea. Kids in H/S are just assholes to begin with and if they smell one speck of weakness, they attack it like a pack of wolves. It sucks and its unfair but these kids have enough issues let alone some jackass beating them up for no good reason. I think if a strong group for the homosexual community (GLAAD I am looking right at you) worked to fight for this idea and tried to subsidize a lot of it with private funds (which I believe would happen b/c from my experiences with the gay community they band together and help each other out) then how can Bloomberg not give them some public money?It would be bad politics.

I dont believe they should be completely subsidized by the public sector, but they should be given something to start out, hell we give some rich billionaire millions to build a baseball field, why not give a million dollars to a school to help kids?

Three points:

Don't be silly. You need look no further than the famous Skokie Nazi march case for an instance where the ACLU went against the Democratic Party, and there's a lot more where that came from.

2 - This is not a "gay-only" school, any more than Howard University is a "black-only" school. That is the group who they are marketing to, and who (probably) most of the attendees will be, but they cannot explicitely only let in gay students (although I have no idea what straight kid is going to want to go to the "gay school," although maybe times have changes more than I thought).

3 - a great deal of this school is privately financed, meaning that in terms of raw dollar figures, the amount that the New York City Public School system spends per student (all around) is greater because this school exists.

Having just gone to 2 straight Tori Amos concerts, I can safely say that the "fag hag" population is quite high, and could easily picture girls who would love to go to a school where they can share makeup tips with the guys. ;)

I'm waiting for this to turn into the movie "Just One of the Bi's" where the teenager who is straight acts gay to get into the gay high school so he'll have a better chance to go that Ivy League school he'd never get into if was just a (ummm...searching for non-offensive generalizing term here..."normal", nope..."regular", won't work..."average", probably not) heterosexual person at a non-homosexuals-only (or -preferred, as the case may be) school.
