Judge orders sex predator released

SAN JOSE, California (AP) -- A judge on Tuesday again ordered that a serial child molester who has completed a state-mandated sex offender treatment program be released this week to live in a trailer outside a prison in rural central California.

Lawyers and residents from a town near the prison urged Judge Robert Baines to delay the release of Brian DeVries, but Baines said he must be sent to Soledad by Friday or he will be released to his father's custody in Washington state.

Baines said keeping DeVries in a state hospital may be unconstitutional and that giving Soledad residents more time to prepare for his arrival was unnecessary.

"The program is elaborate and can certainly assure every resident ... that Mr. DeVries' placement will not in any way be a risk to them or their families," Baines told a courtroom packed with Soledad residents.

DeVries, 44, successfully completed the program at Atascadero State Hospital more than a year ago. In February, Baines agreed that DeVries was ready for the program's final outpatient treatment phase, and ordered the state to find him a home.

DeVries would be the first person to complete the treatment and be released into the community since the program began in 1996. He molested at least nine young boys in New Hampshire, Florida and San Jose before serving his last, four-year prison term.

To help demonstrate his intent to reform, DeVries was castrated in August 2001.

"I knew molesting was wrong," he said in an interview last month. "I wanted to stop doing it."

DeVries, who has pledged to live a "kid-free" life, has been locked up in the hospital or in prison since September 1993.

After more than 100 potential landlords refused to house DeVries, and the state Department of Mental Health decided to place him in a mobile home outside a medium-security prison near Soledad, about 110 miles southeast of San Francisco.

City residents objected and a judge delayed DeVries' release, originally planned for no later than Aug. 10.

"All we are asking for is more time," Kim Colwell of the city attorney's office told the judge Tuesday. "A short delay so everyone can take a deep breath and figure out what our responsibilities are."

Baines pointed out that, according to the Megan's Law database, 58 sex offenders already live in the Soledad area and none of them have the "massive supervision" that DeVries will experience.

"We don't want this guy in our town. This guy is sick," said Miguel Gutierrez, a Soledad resident who came to San Jose to protest the release. "He should go to a place in the desert where there's no kids around."

California's sexually violent predator law lets the state lock up repeat sex offenders after they serve prison sentences and force them to undergo treatment until they're no longer deemed a threat to society. Atascadero houses about 400 such offenders.

To be perfectly frank... YEAH. His death would likely be regarded as No Big Loss.

Sorry to sound mean, crass or downright homicidal, but I'm a teacher and a child molester is the LAST guy I'll have sympathy for.

I'm not saying that the guy would be an asset to every neighborhood... but given that he's (a) gone through a state-supervised rehab program, (b) openly admitted that what he did was wrong, and (c) voluntarily been NEUTERED in support of that, I find it hard to believe that DeVries 2003 presents the same threat to children and society as DeVries 1993. I wouldn't want him managing my kids' day-care center, but that's not what they're releasing him to do.

To put it another way, if he's "hardwired" to lust after kids, therapy alone wouldn't change him, any more than it would turn gays straight or addicts clean. Therapy, a desire to change, and making his testicles non-functional WILL significantly trim those urges (particularly the latter).

He has to go somewhere. He's paid his debt to society for his crimes, so to speak; you can't just throw him in a well and pretend he doesn't exist.

I guess this can go back to the fundamental debate about whether our penal system is about Containment/Punishment or Rehabilitation. We talk the rehab talk, but we seem to walk the contain and punish walk--most notably when criminals are permanently stripped of their rights and when *lots* of enmployers won't hire someone with a record.

The answer for the former felon, often, then is to fall back into the exact same activities that got you arrested in the first place. A vicious cycle at times, I think.

I'm not suggesting that anyone should feel overly comfortable with this guy around their neighborhood, specifically, but the circumstances surrounding his release do raise an interesting debate.

Is the penal system about containment/punishment or rehabilitation? How about protection of the innocent? You can't tell me that there is a single responsible parent in that community who won't have this guy at least in the back of their mind every time their child goes off to school, to a friend's house, or even to play in the park. Maybe it's just me, but I think the rights of innocent people to feel safe in their home and their community far outweighs the right to freedom of a child molester, whether the government thinks he's rehabilitated or not.

Of course parents should worry. That's what parents are for. For my money, though, they should worry more about the pedophiles that the authorities don't know about yet and who have functioning gonads than a guy who doesn't match either criteria.

The man is a convicted child molester. What kind of crazy logic suggests you worry more about possible or potential child molesters then the convicted one moving in next door? I know he had himself castrated, but this isn't an exact science. We don't know what motivates the molester to molest. We only know that once they start, they rarely ever stop. We had a case here in Mass. a few years ago, involving a young kid named Jeffrey Curley, who was the same age as my little brother is now when Curley was kidnapped, raped, and killed. Will the removal of deVries testicles remove his desire to molest? Does it take testicles (literally, not figuratively) to kill a small boy? We just don't know. And since we don't know, then I damn sure expect parents to worry about this guy. Just my opinion, but when you commit a pretty heinous felony, you forfeit your rights to exist on the same plane was the rest of us.

Obviously, the potential for violence is still there (as it is with you, with me, and with every other human being on the planet.) Anyone, whether male or female, can kill someone. But there aren't too many eunuchs out there with raging, out-of-control sex drives, are there?

This guy will be under a microscope for the rest of his life. He won't be able to shop for groceries, walk down his street or break wind without someone knowing about it. That's something he brought upon himself through his actions, and I'm not particularly tearful about that; that's what happens when you commit a horrible crime. Nobody's recommending him to be the town's Little League coach.

But most child molestors are people that the children know and trust (family, friends, respected elders). The kids of Soledad are a lot more likely to be groped by someone in that category than by a neutered and supervised ex-con who, if he knows what's good for him and is sincere in his repentance, will be staying as far away from children as he can.

He's got to live somewhere. He's a free man now. What would you suggest?

Let's look at the whole picture.

This guy isn't a violent offender. If he were, or if he posed a significant risk of becoming one (according to people who are considerably more qualified to judge such things than a group of wrestling fans on a message board) he wouldn't be up for release at all.

The chance does exist, of course. But I somehow doubt the chance is any greater in this guys' case than in any of the other FIFTY-EIGHT sex offenders in the same area... and, in fact, might be considerably less since he's under a shitload more scrutiny than the rest of them.

I think part of the problem ref'd by this thread is a concern that kids can't make educated decisions... if they aren't being educated.
