if he has criminal intent (like attempted murder, your bullet could miss by a mile, but you attempted to murder someone. if he's attempting to assult them, and doesn't, he can be got on attempted sexual abuse) or the child feels "uncomfortable" he can be brought on sexual/emotional abuse charges...

As it turned out, MJ was referring more to the mucus which covers a newborn, not the actual placenta.
