Wrestler-turned-actor 'Rowdy' Roddy Piper is facing up to six months behind bars after he was charged with driving under the influence (DUI).
The semi-retired grappler, real name Roderick Toombs, was arrested in Hollywood on 2 July after failing a field sobriety test.
According to TMZ.com, the Los Angeles City Attorney has now filed a misdemeanour count of DUI against Piper, as well as one count of driving without a valid licence.
If convicted, the 55 year old could be sentenced to jail time and subjected to a $1,000 (£665) fine.

NO. Prior bad acts cannot be admitted into evidence, or considered in sentencing.

AND you're a sheriff.
I'm pretty sure "prior bad acts" can be considered in sentencing, at least insofar as leniency might be shown to a first-time offender but not to a repeat offender.

Well, they can't be the primary or the mitigating factor in sentencing. Prior bad acts can be A reason, but not THE reason, if that makes sense.
