But, Guerra's pod was given away, something usually not done if someone is only injured. Plus, by dying it provides additional reasoning for Alvarez to just give up. Usually if they live through these episodes, they are shown being taken into/treated at the hospital, so my guess is Guerra should count as dead in the pool.

In addition to the stuff mentioned above, they never showed him in the infirmary or being led out of OZ or on the bus at the end. I really think you're supposed to think he dies. And regardless, I was the only one who picked him, and I'd still come in third either way (tiebreaker is most correct picks).
