Aren't the Satellite Radio companies aware of this and doing what they can to make sure its difficult for people to record the programs? I know that XM recently pulled their PC adapter after someone wrote a program to timeshift (record) their programs a la Tivo. Although I have heard that they are going to be rereleasing it.
Granted, nothing can stop anyone from putting a microphone in front of their speakers, but one would have to think the quality wouldn't be the best.
The thing I've done with my XM is to run it through my VCR and then put in a videotape and record it that way. So, I watch "the radio" on my tv with a black picture and the XM audio. | vsp

Do you need exceptional quality for a radio show that's 98% talk? There are a bunch of programs out there that can convert raw audio (say, radio -> line out -> PC sound card line in -> speakers) to .MP3 on the fly, Total Recorder being the one I know best. Its output is quite acceptable to my tin ear.
Right now, I'm looking at a particular USENET newsgroup where people have been posting just about every radio show you can think of for years. Right-wing talk radio pundits, Air America, Don & Mike, O&A, Ron & Fez, Loveline, Phil Hendrie, Tom Leykis, all there on a daily basis. This is nothing new, and since all but O&A are broadcast over free radio, nobody's raised an eyebrow about it (that I know of, anyway). When premium radio becomes more common, though, I wonder when and if satellite radio companies will try to crack down. ("Try to" is the operative phrase, as we all know half-a-dozen ways of distributing .mp3s.)

He said "No." They feel that those mediums are very different from traditional radio and broadcast TV and do not need to be regulated under today's standards.

If Sally Soccer-Mom pulls her kid-loaded SUV up next to someone listening to O&A or Stern at a traffic light, and if they're broadcasting live audio simulating a midget in a sailor suit sodomizing a housecat at that particular moment, I can see letter-writing campaigns to the FCC and Congress demanding the removal of the Indecent and Obscene Threat to All That Is Good And Pure In American Society Because the Children Must Be Protected.

I'm not so sure. That kind of thing happens everyday with offensive rap music being blasted out of people's cars, and there's really not much you can do about it except roll up your windows & hope the light turns green soon.
Eventually, I'm sure the FCC will "draw the line" somewhere in regards to what can & what cant happen on satellite radio, but I doubt they'll have nearly as many regulations as they do for AM/FM radio. | Grimis

That is true, but they are starting to pass laws forbidding the viewing of "adult entertainment" on DVD players in moving vehicles for the same reason. So there is a thin precedent there.... | fuelinjected

I'm sure they'll try to get after satellite radio but really that no-porn DVD thing is shaky at best but the FCC and these groups like "Morality in the Media" have to latch onto something before they become obsolete and stop using your money for free first class trips to Vegas and New Orleans.
I know here there are certain "noise pollution" type laws where someone could complain about people blasting extremely loud music and causing a disturbance. I think that would be the only fair way for people to get after those who blast their satellite radios or profanity laced CDs around children. | odessasteps

Indecency provisions were dropped when a group of Senators pushed to include a provision that would prevent the FCC from relaxing its media ownership rules. In fact, all language relating to media issues were stripped out of the Defense bill, including an amendment requiring the FCC to study violence on television and how well children are protected from it.
