I really think people would be against recasting it anyway, but I don't think it would hurt the franchise's numbers if they did. Still no word on what the villain will be.

Well, good. I never thought there was ever any serious intent to recast the role or even bring The Joker back for Nolan's third Batman. But if they did, they should cast Edward Norton. Or Eric Bana. Or Joaquin Phoenix.

So, for storyline purposes, we'll just work under the assumption that the Joker is locked up tight in Arkham for the duration of the film (no doubt concocting his inevitable escape)?

Or perhaps, in this reality, Gotham City actually has the death penalty ... seeing as how he did off a bunch of cops, blow up at least two buildings (one of them being the police station), and various other death-penalty-able offenses.

I'd think the "locked up in Arkham" idea would be the way to go. Even having a shot inside Arkham of a shadowy figure sitting on the floor with a straight jacket on and "Joker" on the door would be a good enough callback scene. And I bet there is some cutting room floor footage of Heath Ledger that could be re-purposed for quick flashbacks or whatever needs to be done if Nolan' story calls for any short Joker involvement.

I'm really glad this movie isn't being rushed out like so many franchise sequels have been lately. The Dark Knight/Iron Man/Hulk combo from the summer of 2008 was so good that it doesn't even feel like there's been another summer blockbuster season since then as not much else has compelled me to visit the theatre.

Interesting scenario you bring up about the death penalty. As a city, I doubt Gotham City could have a death penalty, but since Gotham is actually Chicago in Nolan's Batuniverse, it turns out the state of Illinois does have the death penalty.

An execution scenario is totally unlikely. They're not going to acknowledge Ledger's death by having his character also be mentioned as being offed, that'd definitely be seen as a little tasteless. I'd bet that Joker just isn't mentioned for the entire film --- maybe a few past references to 'chaos in Gotham' but no specific callbacks.

Why do people feel he should be shown?
I don't think they showed Ra's al Ghul in the 2nd movie?
Definitely no new scenes. And Scarecrow was still on the loose at the end of the first one, so it made sense that he had a cameo.

Everyone who at least knows Batman a little bit will know theý lock all the criminals in Arkham asylum until they escape. There's no need to give the guy (or his CGI form) a special appearance.

Ra's al Ghul wasn't seen at the end of Batman Begins saying, "you and I are destined to do this forever." Also, he died in a train crash, and I don't think there are any immortals in Nolan's Batman.

I don't think they should or will continue with Joker now that Ledger is dead, but had he not died I think they should have and would have. Not necessarily as a primary antagonist, but he is Batman's signature foe after all.

Ok, good point. I forgot about that line.
But still "destined to do this forever" doesn't mean he has to show up in #3. If Batman turns to Gordon saying "Is he still secure" "Yes, 24-7 surveillance" than they done their job for one entire movie.
Throw in a "We've got our best doctor, Ms. Quinn, working with him" to throw fans a bone.

To be technical, and a bit OT, and a bit anal, and a bit annoying, and a bit repetitive, Illinois does not enforce the death penalty. Governor Ryan issued a moratorium about ten years ago and we have not killed anyone yet, nor plan to. It's true that a prosecutor can seek the death penalty and receive a sentence, but the state would not carry out the penalty. T

his all came about after thirteen people on death row were proved innocent by DNA testing. At the same time, the state killed...thirteen people. Not great odds.

I really want to see a really good (and new) take on the Riddler. He's one of my favorite Bat Villains, but rarely gets utilized to his full potential.
